Norf Guide Website Terms and Conditions

Using the Norf Guide Website
Hot Rod Design Pty Ltd (ACN 114 670 898) (Hot Rod) operates the Norf Guide Website (Site) and publishes the online Norf Guide. These terms and conditions apply when you use the Site, submit content to the Norf Guide and place a booking for listings and advertising with Hot Rod. Hot Rod may update the terms and conditions from time to time. By using the Site, or submitting content, you agree to the terms and conditions applying at the time. You must not do anything harmful to the operation of the Site or which is unlawful.

Norf Guide
Norf Guide features the hidden gems of Melbourne's inner northern suburbs. Norf Guide is a free publication available on the street and online. We publish two issues and four editions of Norf Guide each year. The Site is updated for each issue, and at other times.

Website content
The Site includes content created by Hot Rod as well as content submitted by other parties, such as our contributors and advertisers. We compile the information contained in this Site in good faith and attempt to confirm the accuracy of such information at the time of inclusion. However, due to the type of information contained in the Site we do not warrant or represent that the information is accurate, without error, or current when you access the Site. Neither do we warrant or represent that the products or services referred to in the Site are suitable for a particular purpose. You should verify information (including details such as telephone numbers and addresses) before relying on that information.

Intellectual property
Unless specifically stated, we own or have permission to use the intellectual property rights (including copyright) in the content and layout of the Site. You can use the content in the Site for personal use and to inform others about the Norf Guide but otherwise you must not copy, reproduce, modify or circulate the content in the Site except with our permission. You must not interfere with our rights in the intellectual property contained in the Site. You acknowledge that use of Site does not grant you any rights in respect of any content contained in the Site. All trade marks displayed on the Site are owned by the respective trade mark owners.

Submitting content
You are responsible for submitting content to us in complete and error free form, in a format that complies with our technical specifications and by the deadlines that we determine. By submitting content to us, you agree to grant Hot Rod a non-exclusive, perpetual, royalty-free licence to use, modify and reproduce the content. We may use the content you submit without restriction, including in the Norf Guide (both online and print versions). We may modify, update or remove your content at any time. You acknowledge that Hot Rod is under no obligation to use your content at all, and may decide not to include your content in the Norf Guide. You agree that Hot Rod owns all rights, including intellectual property rights, in content designed and developed by Hot Rod on your behalf.

Warranties
You are responsible for the content you submit to us. You warrant to Hot Rod that:
(a) you are authorised to submit the content you contribute;
(b) the information you submit is true, accurate and complete;
(c) the content does not contain illegal, obscene, offensive, defamatory, or misleading statements, images or meanings;
(d) the content does not infringe any intellectual property rights of any person;
(e) the content does not contain information personally identifying any person without their consent (whether directly or indirectly);
(f) you consent and have obtained all appropriate consents for us to modify the content or use it without reference to the persons who created it. You acknowledge that the word content when used in the terms and conditions means content in any format, including any text, images, photographs, graphics, video and audio content.

Liability
You are liable to us if you breach these terms and conditions and for negligence in relation to your use of the Site or content submitted. You agree to indemnify Hot Rod, its officers employees and agents against all claims, damage, loss, liability, costs (including legal costs on a full indemnity basis) or expenses suffered or incurred by Hot Rod as a result of a breach of these terms. To the extent permitted by law, Hot Rod excludes all warranties, express or implied, in relation to the content of this Site. Hot Rod, its officers, employees or agents will not be liable for any claims, damage, loss, liability, costs (including legal costs on a full indemnity basis) or expenses whatsoever including but not limited to loss of profits, loss of information, consequential, indirect, incidental or special damages suffered or incurred as a result of your use of the Site, or reliance on the information contained in the Site. You acknowledge that Hot Rod makes no warranties in respect of any content or the level of impressions to be achieved. Hot Rod's liability for breach of any implied warranty or condition which cannot be excluded is limited at the option of Hot Rod to supplying the relevant goods or services again or payment of the costs for the supply of equivalent goods or services.

Listings and advertising
There are specific requirements which apply to listing and advertising bookings. The specific requirements do not affect your general obligations in relation to content you submit to us. By submitting a listing or advertising booking to Hot Rod, you agree to pay all relevant fees and costs for your booking according to our current published rates. All listings and advertising bookings must be paid in full before publication in the Norf Guide. Any booking you place is binding and can only be cancelled upon payment of Hot Rod's cancellation fee. All of the listing and advertising rates are subject to change. All fees, rates, advertising and other payments specified by Hot Rod are inclusive of GST. You must pay all taxes, duties and charges payable or assessed. We may refuse or cancel any listing or advertising booking at any time.

External links
The Site may include links to other sites, such as advertisers and contributors sites which are not operated by Hot Rod. We are not liable for your access or use of external sites.

Miscellaneous
This Site is intended for residents of Australia only. The terms and conditions and use of the Site are governed by the laws of Victoria, Australia.

9. Miscellaneous
These terms and conditions and the booking form you complete taken together constitute the entire agreement between the parties and supersede all prior arrangements with respect to its subject matter. The parties acknowledge that any supplementary or extrinsic arrangement for services falling outside the subject matter of this agreement will be subject to a separate services agreement between them. Hot Rod may send an email to you for any notices. If any provision of the terms and conditions is held to by a court to be void, unenforceable or unlawful it is to be severed so that the validity and enforceability of the remaining provisions are not affected. These terms and conditions are governed by the laws of Victoria, Australia.
